User Accounts

Account Creation

To use certain features of our services, you must create an account. You agree to:

• Accept all responsibility for all activities that occur under your account

Account Termination

Payment Terms

Pricing

Our pricing is clearly displayed on our website. All prices are in U.S. Dollars unless otherwise stated. We reserve the right to change our prices at any time, but changes will not affect orders already placed.

Payment Processing

Payment is required before work begins on your project unless otherwise agreed in writing. We accept payment via credit card, debit card, and other methods as displayed on our website. All payments are processed through secure third-party payment processors.

Refund Policy

All sales are final. However, if you are unsatisfied with our services, please contact us within 30 days of service delivery to discuss your concerns. We will work with you in good faith to resolve any issues.

Non-Profit Program

Our non-profit sponsorship program provides free website development to qualifying 501(c)(3) organizations. Eligibility is determined at our sole discretion. Hosting fees are separate and apply to all users, including non-profits at discounted rates.

Intellectual Property Rights

Our Intellectual Property

All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, are owned by JIGOMIT or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any content you provide to us for inclusion in your website. By providing content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the content solely for the purpose of providing our services to you.

Website Deliverables

Upon full payment, you will own the final website design and custom code created specifically for your project. However, we retain the right to use third-party libraries, frameworks, and components, which are subject to their respective licenses.

Limitation of Liability

To the maximum extent permitted by law, JIGOMIT and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or use
• Business interruption
• Loss of goodwill or reputation
• Cost of replacement services

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation

We do not warrant that our services will meet your requirements or that any defects will be corrected. You use our services at your own risk.

Indemnification

You agree to indemnify, defend, and hold harmless JIGOMIT and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your violation of any third-party rights
• Any content you provide to us

Termination

Either party may terminate the service agreement with 30 days' written notice. Upon termination:

• You must pay for all services rendered up to the termination date
• We will provide you with all completed work and files
• Hosting services will cease after the current billing period ends
• You are responsible for backing up your website data

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or our services shall first be resolved through good faith negotiations. If the dispute cannot be resolved within 30 days, either party may pursue binding arbitration in Ahmedabad, Gujarat, India.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
